Terms of Service

These Terms of Service ("Terms") govern your use of DriveTrace, an independent app built and operated by a single developer trading as New Street Technologies ("we", "our", or "us"). By creating an account or using the DriveTrace mobile application, website, or any related services (collectively, the "Service"), you agree to these Terms.
If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use DriveTrace (16 in the EEA/UK). By using the Service you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has reviewed and agreed to these Terms on your behalf.
2. Your Account
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You must provide accurate information when creating an account. Do not impersonate anyone or create accounts for others without their permission.
- DriveTrace supports multi-factor authentication (MFA) including passkeys, TOTP authenticator apps, SMS codes, and email verification. Tenant owners may enforce MFA for all members. You are responsible for maintaining access to your enrolled MFA methods.
- Notify us immediately at hello@drivetrace.app if you believe your account has been compromised.
- One account per person. You may not share your account credentials with others.
3. The Service
DriveTrace provides real-time location tracking, trip history, driver safety scoring and rewards, named places and geofences, multi-user management, and a self-service tenant portal for iOS, Apple Watch, and the web. The Service is provided on three tiers — Free, Residential, and Commercial — as described at drivetrace.app/#pricing.
- The Free plan is subject to daily tracking hour limits and shorter data retention. Limits may be adjusted over time.
- The self-service tenant portal at drivetrace.app/app allows tenant owners and administrators to manage members, devices, places, reward programs, scoring configuration, subscriptions, and security settings.
- Each tenant's data is isolated at the database level using Row Level Security (RLS). Your data is not accessible to other tenants.
- We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of significant changes where possible.
- The Service requires Always-On location access on iOS. Features are substantially limited if this permission is not granted.
4. Subscriptions & Billing
Paid plans (Residential and Commercial) are billed monthly. Pricing is shown at drivetrace.app/#pricing and includes a base plan fee plus a per-device fee for each registered device.
- Subscriptions renew automatically at the end of each billing period unless cancelled.
- You may subscribe via the iOS App Store (Apple In-App Purchase), our website using a credit or debit card (Stripe), or PayPal. Billing terms are subject to the policies of the payment processor used.
- Prices are in US dollars and are subject to applicable taxes.
- We reserve the right to change pricing with at least 30 days' notice. Continued use after a price change takes effect constitutes acceptance of the new pricing.
5. Cancellation & Refunds
- You may cancel your subscription at any time. Access continues until the end of the current paid billing period; no partial-period refunds are issued.
- For subscriptions purchased via the Apple App Store, refund requests are handled by Apple in accordance with their policies.
- For subscriptions purchased via our website (Stripe or PayPal), refund requests within 7 days of an initial purchase may be considered on a case-by-case basis. Contact hello@drivetrace.app.
- We reserve the right to issue refunds at our discretion. Refunds are not guaranteed.
6. Acceptable Use
You agree not to use the Service to:
- Track any person without their knowledge and explicit consent. You are solely responsible for obtaining consent from all individuals whose devices are added to your group.
- Violate any applicable law or regulation, including privacy laws in your jurisdiction.
- Interfere with, disrupt, or attempt to gain unauthorised access to the Service or its infrastructure.
- Reverse engineer, decompile, or attempt to extract the source code of the app.
- Use the Service for any commercial purpose not expressly permitted by your plan.
Covert tracking is prohibited. DriveTrace must only be used to track devices belonging to individuals who are aware they are being tracked and have consented. Using DriveTrace to covertly monitor another person may violate criminal law in your jurisdiction. We may suspend or terminate accounts where covert tracking is suspected.
7. Location Data & Consent
By enabling location tracking for yourself or inviting others to your group, you acknowledge:
- You have obtained the freely given, informed consent of each person whose device you add to your group.
- Members can view each other's live location and trip history as permitted by the group's settings.
- Any member can leave a group at any time from the app, which immediately stops sharing their location with the group.
- Location data is processed in accordance with our Privacy Policy.
8. Driver Safety Score & Rewards
DriveTrace calculates a safety score for each trip based on driving events such as hard braking, speeding, and harsh acceleration. Scores are used to award or deduct points according to configurable rules set by the tenant owner.
- Safety scores are derived from sensor data and GPS speed. They are indicative of driving patterns and are not a definitive measure of safety. DriveTrace does not guarantee the accuracy of safety scores.
- Points accumulate in a ledger and become redeemable after a vesting period configured by the tenant owner (weekly or monthly). Points may be positive or negative.
- Tenant owners configure the reward catalog, including reward descriptions, point costs, and whether redemption is instant or requires approval. DriveTrace facilitates the redemption process but does not provide, fulfil, or guarantee any rewards — fulfilment is the sole responsibility of the tenant owner.
- Badges and leaderboard rankings are provided for informational and motivational purposes only.
- Scoring weights, baselines, and reward programs may be changed by the tenant owner at any time. Changes apply to trips recorded after the change.
9. Data Residency
By default, all tenant data is stored in the United States on Google Cloud infrastructure. Commercial plan subscribers may request that their data be stored and processed in a specific geographic region.
- When a regional deployment is provisioned, all tenant data — including location records, trips, personal information, safety scores, and rewards — is stored and processed exclusively within the chosen region.
- Data residency does not affect the use of third-party payment processors (Stripe, PayPal, Apple), whose data handling is governed by their own policies.
- Availability of regional deployments is subject to infrastructure capacity. Contact hello@drivetrace.app for current options.
- Migration between regions may require a brief service interruption and is performed at our discretion upon request.
10. Intellectual Property
DriveTrace, its logo, and all associated software, designs, and content are the property of New Street Technologies and are protected by applicable intellectual property laws. These Terms do not grant you any right, title, or interest in the Service beyond the limited licence to use it as described here.
You retain ownership of your data. By using the Service, you grant us a limited licence to store and process your data solely to provide the Service to you.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. Location accuracy depends on your device's GPS hardware and environmental conditions; we make no guarantee as to the precision of any location or trip data.
DriveTrace is not a safety-critical system and should not be relied upon as the sole means of locating a person in an emergency.
12. Limitation of Liability
To the fullest extent permitted by applicable law, New Street Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of data, loss of revenue, or personal injury.
Our total liability to you for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim. If you are on the Free plan, our liability is limited to $10 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
13. Termination
You may delete your account at any time from Settings → Danger Zone → Delete Account. This immediately removes your personal data as described in our Privacy Policy.
We reserve the right to suspend or terminate your account without prior notice if you violate these Terms, in particular the acceptable use provisions in Section 6. If we terminate your account for a reason other than a Terms violation, we will provide a pro-rated refund for any unused portion of a paid subscription.
14. Changes to These Terms
We may update these Terms from time to time. For material changes, we will notify you via in-app notification or email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not accept the changes, you may delete your account before the effective date.
15. Governing Law
These Terms are governed by and construed in accordance with applicable law. Nothing in these Terms limits any rights you may have under the mandatory consumer protection laws of your country of residence.
